The league would need to be involved but initiated by the team. That's how I understood what he said at least.

That's the right of the guy who wears the big hat. However, he doesn't need to get short with Brown, because Brown is simply doing his job as a media person. Also, if we are to assume that O'Shea is doing something about stupid penalties, we have to also assume that it's not working very well, so the question was fair comment.
